Suhakam: Allow foreign workers to join unions / Lao động tại Mã lai được phép vào công đoàn

KUALA LUMPUR: The Malaysian Human Rights Commission (Suhakam) has come out in support of suggestions by non-governmental organisations (NGOs) and trade unions that foreign workers be allowed to form unions or join existing ones.

Human Rights Commissioner Datuk N. Siva Subramaniam said the commission would recommend the move to the government in its annual report, which will be published later this year.

"Suhakam believes a worker -- local or foreign -- deserves to be treated the same and enjoy the same privileges," he said after Suhakam's roundtable discussion with trade unions yesterday.

The discussion was spurred by recent reports that a Nike T-shirt factory here, owned by local company Hytex Integrated Bhd, had allegedly abused its foreign workers mainly from Bangladesh and Vietnam, by confiscating their passports and garnishing their wages.

Subramaniam said the "Nike incident" was just one of many cases of foreign worker abuse.

He added that Suhakam received an average of two complaints a day from foreigners claiming mistreatment.

Also present at the meeting were representatives of the Congress of Unions of Employees in the Public and Civil Services (Cuepacs), Malaysian Bar Council, Tenaganita and Malaysian Trades Union Congress.

Subramaniam said the government announced on Nov 13, 2005 that foreign workers employed in Malaysia would be treated equally in accordance with provisions under the International Labour Organisation convention.

It includes the right of foreign workers to form or join unions.

"However, many companies still mistreat their workers, to the point where it borders on slavery going against the ILO convention.

"We must ensure that all foreign labour is treated humanely. This includes providing good living conditions, fair wages and the guarantee of basic human rights," Subramaniam said.

Suhakam vice-chairman Tan Sri Simon Sipaun said the commission's previous recommendations to the government on the rights of foreign labour had not been well received.

"I invite other NGOs to join us in this initiative to fight for the rights of foreign workers," he said.
